HamdamChat provides AI-powered companion characters for entertainment and emotional support purposes. You understand and agree that:
- All companions are fictional AI characters — they are not real people.
- All conversations, messages, photos, and voice notes generated by companions are produced by artificial intelligence.
- Any resemblance to real persons is coincidental.
- Companions do not have genuine emotions, memories, or consciousness.
- The Service is for entertainment purposes only and does not constitute therapy, counseling, or medical advice.
- You should not rely on AI companions for mental health support — please seek qualified professional help if needed.
User Accounts
You may use HamdamChat as a guest or by creating an account. If you create an account, you agree to:
- Provide accurate information during registration.
- Keep your login credentials confidential.
- Be responsible for all activity that occurs under your account.
- Notify us immediately at hamdamchat@outlook.com if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms.
Premium Subscription & Payments
HamdamChat offers a free tier and a paid Premium subscription. By subscribing to Premium, you agree to the following:
- Billing: Premium is billed at $4.99 per month (or the price displayed at checkout). Payment is processed securely through our payment provider.
- Recurring billing: Your subscription renews automatically each month until you cancel.
- Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period. You retain Premium access until then.
- Refunds: We offer a 7-day refund for new subscribers if you are unsatisfied. After 7 days, payments are non-refundable. To request a refund, email hamdamchat@outlook.com.
- Price changes: We will notify you at least 14 days before any price change takes effect.
Acceptable Use — What You May Not Do
You agree not to use HamdamChat for any of the following:
- Attempting to deceive the AI or other users in harmful ways.
- Using the platform to generate, distribute, or promote illegal content.
- Harassing, threatening, or abusing other users or our support team.
- Attempting to reverse-engineer, scrape, or copy the Service or its AI models.
- Creating multiple accounts to bypass free-tier limits.
- Impersonating other individuals or organizations.
- Uploading malware, viruses, or any harmful code.
- Any activity that violates applicable laws or regulations.
Violation of these rules may result in immediate account suspension without refund.
User-Generated Content
If you upload photos, send messages, or create custom companion profiles, you retain ownership of that content. However, by submitting content to HamdamChat, you grant us a non-exclusive, royalty-free license to use that content solely for operating and improving the Service.
You confirm that any content you upload does not violate any third-party rights, including copyright, privacy, or intellectual property rights.
AI-Generated Photos & Content
HamdamChat allows users to request AI-generated photos of companions. You acknowledge that:
- All generated images are fictional and created by AI — they are not photos of real people.
- You may not use AI-generated photos to deceive others or represent them as real individuals.
- We reserve the right to limit photo generation based on usage tiers.
- Generated content may vary and we do not guarantee specific results.
Intellectual Property
All content on HamdamChat — including but not limited to companion characters, designs, logos, text, software, and AI models — is owned by HamdamChat or its licensors and is protected by intellectual property laws.
You may not copy, distribute, modify, or create derivative works from any part of the Service without our express written consent.
Privacy
Your use of HamdamChat is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We take your privacy seriously — please read it.
Disclaimer of Warranties
HamdamChat is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure at all times.
- AI responses will always be accurate, appropriate, or suitable for any specific purpose.
- The Service will meet your individual expectations.
Use of the Service is at your own risk.
Limitation of Liability
To the maximum extent permitted by law, HamdamChat and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to emotional distress, loss of data, or loss of revenue.
Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.
Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms, without prior notice or liability. You may also delete your account at any time by contacting us at hamdamchat@outlook.com.
Upon termination, your right to use the Service ceases immediately. Paid subscription amounts are non-refundable except as described in Section 05.
Governing Law
These Terms shall be governed by and construed in accordance with applicable international law. Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If unresolved, disputes shall be settled by binding arbitration.
